SUBSCRIPTIONS OR ADVERTISING AGREEMENTS
All subscriptions or advertising agreements placed by you are subject to acceptance by the Horror Asylum. Horror Asylum reserves the right to revise prices, limit quantities, correct errors in its catalogue of services and refuse subscriptions or advertising agreements at its discretion including, without limitation, orders from distributors, dealers and warehouse stores. All Horror Asylum subscriptions and advertising agreements (including sponsorship) are manageable through Paypal, our third-party merchant. Subscriptions may only be upgraded or cancelled via this service and therefore all subscribers are responsible for the upgrading or cancellation of their subscription accounts in all circumstances. Except as may otherwise be permitted by applicable law, you may not cancel an order which the Horror Asylum has accepted without the agreement in writing of the Horror Asylum, which requirement may be waived by the Horror Asylum from time to time in its sole discretion.
The Horror Asylum will not always provide an advertiser with advertising that precedes the payment in full. Payment in full is usually required before any advertising agreement can be acknowledged and advertisers must be aware of this fact before planning any scheduled advertising of any type at The Horror Asylum.
On occasions where due to a predetermined agreement or scheduling issue an advertising schedule is commenced ahead of payment the advertiser should be aware that any early cancellation or non-payment within given invoicing terms will result in a cancellation fee and small administration charge. The cancellation fee is calculated as 20% based on the non-discounted amount of any given advertising provided to the client/advertiser(s) at the time of sale. The administration charge is a fixed fee of $25.00 and covers invoicing and other admin costs. Additional fees may be applicable if advertising has been running on the live site and will be calculated based upon a $0.35 CPM rate on banner impressions and non-discounted rates of our usual RRP costs.
LIABILTY
Nothing in these Terms shall exclude or limit the liability of Horror Asylum for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, the Horror Asylum shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Horror Asylum, its breach or non-performance or any of its obligations under these Terms or otherwise.
These Terms set out the full extent of the Horror Asylum’s obligations and liabilities. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on the Horror Asylum except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.
